A common misconception among Spanish workers regarding vacation rights has been clarified by legal experts. Contrary to popular belief, employers do not have the unilateral right to choose half of an employee's annual vacation days. According to labor law, the dates for enjoying vacation periods must always be mutually agreed upon between the company and the worker. This means that both parties must reach a consensus on the scheduling of the 30 annual vacation days. In instances where an agreement cannot be reached between the employer and employee regarding vacation dates, the worker has a legal recourse. They are entitled to file a lawsuit against the company within a strict timeframe: a maximum of 20 working days from the date the company imposes vacation dates. This legal procedure is designed to resolve disputes and ensure that vacation rights are respected in accordance with the law.
