
HR Expert Warns: Employee Resignations Don't Always Mean Safety

Fiddler explains that while an employee's resignation might seem to resolve a situation, it doesn't always eliminate the company's liability. If the resignation is a direct result of unlawful actions by the company or a manager, it could be classified as constructive dismissal, resulting in legal repercussions. "Constructive dismissal is where the employee leaves because the employer has breached their contract of employment," Fiddler explains, adding that "this has to be in a really serious way." She gives examples such as failing to investigate grievances or creating an overly toxic work environment.
