The expert highlighted that workers have two distinct periods to act, depending on the nature of their claim. According to the legal advice provided, employees who believe their dismissal was wrongful have a strict deadline of 20 working days from the day following their dismissal to file a claim. This period, which only counts Monday to Friday, is specifically for disputing the type of dismissal received. For claims related to unpaid amounts, such as outstanding vacation pay, double payments, or uncompensated extra hours, the deadline is significantly longer, extending to one year from the date the payment was due. The expert emphasized that these rights apply universally to all workers in Spain, irrespective of their administrative status, meaning both those with and without legal documents are entitled to pursue these claims. The firm has successfully recovered thousands of euros for clients in similar situations.
