This statistic underscores a significant public health challenge, with many individuals potentially unaware of the legal provisions available to them. According to legal expert Víctor Arpa, chronic depression that is resistant to treatment and significantly impacts an individual's ability to work may qualify them for a permanent disability pension. Arpa emphasized that the National Social Security Institute (INSS) conducts a comprehensive evaluation, considering a person's clinical history, daily functional capacity, ability to concentrate, and social interactions. He noted that even individuals who can perform telework may be eligible for a pension, which in severe cases can amount to 100% of the regulatory base and be exempt from taxes. "There are already court rulings that recognize this right, even if you can do telework," Arpa stated.
