    Understanding DNI Obligations: An Expert's Perspective on Police Interactions in Spain MADRID – A recent video by security expert Jose de Pedro, known for his "El Búnker" platform, has shed light on the legal nuances surrounding the presentation of Spain's National Identity Document (DNI) to law enforcement. The video addresses a common public misconception: whether individuals are obliged to physically hand over their DNI to police officers upon request. De Pedro clarifies that while the DNI itself is considered "personal and non-transferable," this refers to the unique identification number assigned to an individual, not the physical document's handling during an identification check. Citing Organic Law 4/2015, specifically Article 9, he explains, "All persons obliged to obtain the National Identity Document are also obliged to exhibit it and allow its verification... when requested by the authority or its agents." He further elaborates that officers must be able to "take this document and see if it is manipulated, altered, or falsified in any way," likening it to checking a banknote for authenticity. The expert also touched upon Royal Decree 1553/2005, which regulates DNI issuance, stating that it does not prohibit temporary transfer for verification purposes. He stressed that refusal to comply with an identification request can lead to significant penalties. "If you persist in the refusal... the agent will inform you of what you could face, including detention or a criminal procedure for refusal to identify," de Pedro warned. He cited Article 36.6, which classifies such refusal as a serious offense, carrying fines from €301 to €30,000. De Pedro concluded by emphasizing the importance of knowing one's rights but also fulfilling obligations to avoid unnecessary legal complications. The video has sparked considerable debate online, with some commenters questioning the extent of police authority and the necessity of such identification checks.
