Madrid, Spain - A legal expert has highlighted two critical errors in estate planning that can lead to significant financial and familial complications for heirs. According to lawyer Inaki Barredo, failing to prepare a will or drafting a generic one can result in unforeseen ruin for beneficiaries. "The first major error is not making a will at all," Barredo explained in a recent video. "When there is no will, the distribution of assets is determined by a law from the 19th century, which may not reflect modern family structures or individual wishes." This adherence to outdated legal frameworks can lead to unintended consequences and disputes among potential heirs. The second common mistake, Barredo noted, is creating a generic will that simply names all children as universal heirs in equal parts. "This often leads to family conflicts and lengthy court proceedings," he stated. Such broad statements can fail to account for specific assets, individual needs, or potential disagreements among siblings, forcing families into protracted legal battles that can last between three and five years. Barredo advises individuals to seek professional legal counsel to ensure their wills are comprehensive and tailored to their specific circumstances, thereby safeguarding their legacy and preventing future family strife.
