According to the expert, tenants should create a detailed video and photographic report of the rental unit on the day they move in. This report should capture the state of the property, including any existing damage or wear and tear. This same process should be repeated when the tenant moves out. “The day you enter the property, make a video or photographic report of its condition,” the expert advises. “Anything that is damaged or stained, you must include in this report, in addition to what is not.” Crucially, this comprehensive report should be sent to the landlord via email. This action creates a verifiable record of the property’s condition at both the start and end of the tenancy, providing concrete evidence in case of a dispute over the return of the deposit. “This way, you will have two sets of photographs or video that will demonstrate exactly what you have damaged and what you have not,” the expert explained. Furthermore, the expert highlighted that for disputes involving amounts less than 2,000 euros, tenants are not required to hire a lawyer or solicitor. They can directly present their case to the courts, making it easier and more affordable to pursue the return of their deposit. This legal insight empowers tenants to take direct action if a landlord attempts to withhold the deposit without valid reason.
