Madrid, Spain – In a recent online video, labor lawyer Juanma Lorente provided essential advice for employees navigating potential dismissals, emphasizing key steps to protect their rights. Lorente, known for his expertise in labor law, outlined three critical recommendations for workers. Firstly, Lorente advised employees not to request a dismissal letter if their employer fails to provide one. "One of the requirements for a dismissal to be legal is that there is a dismissal letter," Lorente stated. He explained that without this formal document, the dismissal could be deemed "improper," potentially entitling the employee to significant compensation, including 33 days of salary per year worked, up to a maximum of 24 monthly payments. Secondly, the lawyer stressed the importance of signing any dismissal-related documents as "non-conform." He warned against signing as "conform" without thoroughly reading the contents, as companies might attempt to present a voluntary resignation as a dismissal. "If you sign it without realizing, you're in trouble," Lorente cautioned. Finally, Lorente highlighted the strategic importance of recording conversations if an employee suspects their dismissal is discriminatory. He encouraged individuals to try and get the employer to acknowledge the discriminatory reason on tape. "If you manage to get it and have it recorded, it comes in handy for the trial," he added. Lorente urged viewers to save and share the video with colleagues to ensure they are informed in the event of a dismissal.
