Madrid, Spain – A recent video by legal expert 'Un Tío Legal' has shed light on common misconceptions and potential abuses regarding employee vacation rights in Spain. The video, which has garnered significant attention online, aims to clarify key aspects of labor law concerning holiday entitlements. According to the legal expert, a prevalent myth is that part-time employees are entitled to fewer vacation days than their full-time counterparts. "False," he states, "you have exactly the same number of days, only you are paid at a half-day rate." This clarification is crucial for many workers who might be misinformed about their rights. Another significant point addressed is the fate of vacation days when an employee returns from medical leave. The lawyer asserts that if an employee returns from medical leave, they retain the right to enjoy their vacation days from the previous year, contrary to the belief that these days are lost. "If you return from medical leave, you have the right to enjoy the previous year's vacations," he explains. The video also tackles the issue of employers unilaterally altering or imposing vacation schedules. The expert emphasizes that vacation dates must be known two months in advance and cannot be modified unilaterally by the company, as mutual agreement is required. Furthermore, employers cannot impose last-minute vacations, for instance, due to a lack of work. "The company cannot unilaterally impose vacations," he clarifies. Should an employee disagree with such an imposition, they have the right to take the matter to court to reclaim their vacation entitlements.
