Polish Law to Recognize Self-Employment as Work Experience, Impacting Employee Benefits

Warsaw, Poland - A significant legislative change in Poland, set to take effect in 2026, will alter how periods of self-employment are recognized in an individual's work history. Under the new regulations, time spent operating a business will be included in the calculation of an individual's total work experience, a factor crucial for determining various employee entitlements, most notably the length of vacation leave. Monika Salawa, an accountant, explained the implications of this upcoming change in a recent online video. "Currently, if you close your business and move to an employment contract, the years you spent as a self-employed individual do not count towards your work experience," Salawa stated. "This often means someone with years of business activity might only be entitled to 20 days of vacation instead of 26 days when they start a new job." The new law aims to rectify this disparity. Salawa clarified that the change will not only apply to periods of business activity from 2026 onwards but will also have a retroactive effect, meaning past years of self-employment will also be considered. This adjustment is expected to benefit many individuals who have transitioned between self-employment and traditional employment, ensuring their full professional history is acknowledged for employment-related benefits.
