Madrid, Spain – The Spanish Data Protection Agency (AEPD) has reiterated that hotels are not permitted to scan or make copies of guests' DNI (National Identity Document) or passports. This practice, deemed illegal, has led to significant fines for establishments failing to comply with data protection regulations. According to the AEPD, hotels are only authorized to collect specific personal data, such as the document number, type, date of issue, full name, gender, date of birth, nationality, and the date of entry and signature. This information must be manually entered into their systems and subsequently transmitted to the State Security Forces and Corps, as stipulated by Article 24 of Organic Law 4/2015. The warning comes amidst increasing concerns over cybersecurity and identity theft. Experts highlight that retaining digital copies of identification documents poses a significant risk. In cases of data breaches, such as the one experienced by a major booking platform where guest information was compromised, cybercriminals could gain access to sensitive data, potentially leading to phishing scams, identity impersonation, and fraudulent activities. Citizens are advised to be aware of their rights and to refuse requests for scanning or photocopying their identification documents when checking into hotels, providing only the essential data required by law.
