Madrid, Spain – The National Social Security Institute (INSS) in Spain has confirmed a new measure allowing parents to claim up to five additional years of contribution credit for periods spent caring for their children. This significant change, based on Article 235 of the General Social Security Law and supported by Supreme Court Ruling 1173/2023, aims to mitigate the impact of career breaks on future retirement benefits. Under the new provisions, individuals who have had one or more children and subsequently reduced or ceased their work activity to provide care may be eligible. It is not a requirement to have formally requested a leave of absence (excedencia); rather, proof of reduced professional activity due to childcare responsibilities is sufficient. While the initial announcement may have focused on mothers, it has been clarified that both mothers and fathers are eligible to benefit from this measure. However, only one parent can claim the additional contributions. In cases where both parents are eligible, women are given preference. This initiative allows for up to 1,825 days (five years) of fictitious contributions, which are calculated based on the minimum contribution base of the individual's respective social security regime. These additional contributions are expected to significantly boost the retirement pensions of affected parents. Interested individuals can submit their applications directly to the INSS. Resources, including application templates, are being made available to assist in this process, ensuring that eligible parents can easily claim their rightful contributions.
